Texas Foreclosure Manual – This is a must-have for someone that is new to the market of Texas foreclosures. It is provided by the state of Texas and there is no charge for access.

Texas Law Help – Managed by the Texas Legal Services Center, this non-profit offers legal assistance in Texas to those in need. There is also no charge for accessing their information on foreclosure law in Texas.

 

In non-judicial foreclosures, the trustee or a substitute trustee will be the one to conduct the sale. These auctions can sometimes be referred to as a “trustee sale” or “substitute trustee” sale.

In judicial foreclosures, the auction may be conducted by a county official, often the county constable, or by an agent hired by the local taxing authority (for those involving property taxes).
Texas is a non-judicial foreclosure state. Default is defined in the Deed of Trust (Mortgage) and/or Promissory Note. When a debt is defaulted a Substitute Trustee’s sale will take place in the manner authorized by the Deed of Trust/Promissory Note.
